What to watch for.

  • Amazon TOS on AI-generated listings tightened in 2024-2025. Amazon allows AI-assisted listing copy, but bans fabricated specs, fake reviews, and AI-composited product photos that misrepresent the item. Use AI for drafting; verify every spec against the source.
  • FTC truth-in-advertising applies to AI-generated review responses, email copy, and ad copy. Don't claim awards, certifications, sustainability credentials, customer counts, or testimonials you can't substantiate.
  • Customer PII: order data with names, addresses, and payment info should not be pasted into consumer-tier AI tools that train on inputs. Use Team/enterprise plans, redact before pasting, or self-host. CCPA and state privacy laws apply.
  • CAN-SPAM and SMS opt-in: AI-generated email must include a working unsubscribe and physical postal address. SMS must only go to numbers that opted in to SMS specifically — email opt-in does NOT cover SMS. Include STOP-to-opt-out language.
  • Accessibility: alt-text is legally relevant under ADA storefront precedent (Domino's v. Robles, 2019). AI-written alt-text must describe the image for screen readers — not stuff keywords for SEO.
  • Marketplace photo manipulation rules vary: Amazon main images must be on pure white, no graphics; Etsy allows more creative imagery but bans misrepresentation; eBay bans stock photos for used items. AI-generated or composited product imagery is risky on marketplaces — check category rules.
  • Meta and Google ad disclosure: AI-generated imagery in paid social and search ads now has disclosure requirements in several jurisdictions (EU AI Act, FTC guidance). Tag AI-generated creative in your asset library so disclosure is consistent.
